Management Measures for Accepting Donations of Physical Collections
Chapter 1 General Provisions
Article 1 These Measures are formulated in accordance with the Cultural Relics Protection Law, the Museum Regulations, the Public Welfare Donation Law, and other relevant laws and regulations to encourage donations, standardise donation and acceptance practices, protect the lawful rights and interests of donors, donees, and beneficiaries, and promote the development of public museum undertakings.
Article 2 The term "donation" as used herein refers to the voluntary and gratuitous act of providing physical artefacts to the Dalian Century Sound Museum by domestic and foreign natural persons, legal entities, and other organisations (hereinafter referred to as "donors").
Article 3 Donations shall be voluntary and gratuitous. Compulsory or disguised compulsory contributions are prohibited, and no profit-making activities shall be conducted under the guise of donations.
Article 4 Donations shall comply with laws and regulations, shall not violate public morality, and shall not harm public interests or the lawful rights and interests of other citizens.
Article 5: Donations accepted by the Dalian Century Sound Museum of Music Culture and their appreciation shall constitute public property protected by national law. No entity or individual may appropriate, misappropriate, or damage such property.
Article 6: Donors making outstanding contributions to the Dalian Century Sound Museum of Music Culture shall be recognised. Public recognition requires prior consent from the donor.
Article 7 Donated collection categories include: gold and silverware, bronzeware, ironware, pottery, porcelain, clayware, jewellery, jadeware, stoneware, enamelware, glassware, bone/horn/ivory artefacts, bamboo/wooden artefacts, paper artefacts, textiles, leather goods, audio-visual materials, books/documents, machinery/equipment, and others.
Chapter II Preliminary Donation Assessment
Article 8 Preliminary donation assessment refers to the comprehensive evaluation conducted by the Dalian Century Sound Music Culture Museum on a donation project after receiving the donor's application, but before accepting the donation.
Article 9 Key aspects of preliminary assessment:
(1) Compliance with relevant national laws and regulations;
(2) Alignment with the Dalian Century Sound Music Culture Museum's collection framework;
(3) Necessity of accepting the donation;
(4) Background of the donor;
(5) Feasibility of implementing the donation;
(6) Whether the intended use of the donation involves commercial profit-making activities;
(7) Whether the donation involves unfair competition or commercial bribery;
(8) Whether the donor seeks rights or claims related to the donation matter, such as economic interests, intellectual property rights, scientific research achievements, industry data, and information;
(9) Whether the donation carries political objectives or other ideological biases;
(10) Whether the donation harms public interests or the lawful rights and interests of other citizens;
(11) Other matters deemed necessary by the Dalian Century Sound Recording Music Culture Museum.
Article 10 The donation management department of the Dalian Century Sound Recording Music Culture Museum shall, in conjunction with the institution's finance, asset management, and relevant operational departments, promptly provide an assessment opinion on donation applications. When necessary, third-party institutions and appropriate regulatory authorities may be invited to participate in the evaluation.
Article 11 Preliminary evaluation opinions on donations shall be determined through the Museum's internal democratic deliberation procedures.
Article 12 The Museum shall promptly notify donors in writing of the opinions determined through its internal democratic deliberation meetings. For donations that are not accepted, the Museum shall provide explanations and clarifications to the donors.
Chapter III Donation and Acceptance
Article 13 Donated collections shall be lawful items over which the donor has the right of disposal and which are free from any legal disputes.
Article 14 The Dalian Century Sound Recording Music Culture Museum shall accept donations only upon mutual agreement with the donor and shall execute a written donation agreement. The donation agreement shall be signed by the legal representative of the institution or an individual authorised in writing by the legal representative, and shall bear the official seal of the institution. The agreement shall clearly specify the following:
(1) Donor's name and address (residence);
(2) Type of donated collection items, quantity donated, and commitment to their lawful origin;
(3) Management requirements for the donated collection items;
(iv) The timeframe, location, and method for fulfilling the donation;
(v) Liability for breach of contract;
(vi) Other rights and obligations of both parties to the donation;
(vii) Methods for dispute resolution.
Article 15 Upon accepting a donation, the Dalian Century Sound Recording Music Culture Museum shall issue a donation certificate to the donor as proof.
Article 16 The Dalian Century Sound Recording Music Culture Museum shall adequately protect the personal information of donors and other information that may involve donor privacy.
Chapter IV Registration, Management, and Promotion of Donated Collections
Article 17 The Dalian Century Sound Recording Music Culture Museum shall respect the wishes of donors, register and preserve donated collections in accordance with nationally published standards and specifications, and exhibit them at appropriate times.
Article 18: For significant quantities of donated collections possessing strong historical, artistic, or market value, the Dalian Century Sound Recording Music Culture Museum may organise dedicated donation exhibitions upon expert review approval and consent from higher authorities.
Article 19: When necessary, the Dalian Century Sound Recording Music Culture Museum may employ technical measures such as restoration, replication, or digitisation on donated collections.
Article 20. Donors shall have the right to inquire with the Dalian Century Sound Recording Music Culture Museum regarding the usage and management of donated collections and to offer opinions and suggestions. The Museum shall provide truthful responses to such inquiries.
Article 21. The Dalian Century Sound Recording Music Culture Museum shall conduct regular inventory checks of donated collections in accordance with relevant regulations on collection management to ensure that records match physical holdings.
Article 22 After all donated items have been fully incorporated into the collection and all donation procedures have been completed, the Longping Museum shall conduct publicity activities as appropriate to enhance its social influence.
Chapter V Supplementary Provisions
Article 23: These Measures shall be implemented on a trial basis from the date of promulgation.
